The checklist for requests for advice and consent
Take control of the decision-making process and make your works council work more effective!
The process of requests for advise and consent (RFA and RFC) can be complex and requires careful consideration. Our practical checklist provides clarity and structure as you navigate these important decisions. This checklist is specifically designed to support works councils at every stage of the process, from assessing the proposed decision to issuing the final recommendation.
What does this checklist offer?
Our checklist is divided into four crucial phases that help ensure you don’t overlook any important steps:
- Phase 1: assessment (for the Works Council and management jointly)
– Establish clear agreements regarding confidentiality and response deadlines.
– Identify which strategic pillars and WOR provisions are relevant.
– Ask substantive questions about the proposed decision, the rationale, and the consequences for employees. - Phase 2: assessment (Works Council only)
– Start with a substantive check-in: how does this decision affect you as a Works Council member?
– Conduct an internal assessment: what are the benefits, risks, and objections? What are the Works Council’s requirements and recommendations? - Phase 3: negotiation (Works Council and management jointly)
– Discuss whether and how the proposed decision can be amended based on the Works Council’s assessment.
– Ensure that clear agreements are made regarding the implementation of the amended decision. - Phase 4: decision-Making (Final Recommendation by the Works Council)
– Ensure that the final recommendation is cleary formulated and that the evaluation and monitoring of the decision are properly arranged.
– Document how and when the decision will be communicated to employees.
